1. Xunfei Healthcare Products: "Xunfei Healthcare Products" are the software/hardware products provided by Xunfei Healthcare  (https://www. iflyhealth.com/).

 

2. Xunfei Healthcare Services: "Xunfei Healthcare Services" (hereinafter referred to as "this Service") are the customized and non-customized medical solutions and other services provided by Xunfei Healthcare Technology Co., Ltd. (operator of Xunfei Healthcare ) to users.

 

3. Xunfei Healthcare Technology Co., Ltd.: "Xunfei Healthcare Technology Co., Ltd." is the operator of Xunfei Healthcare , specializing in intelligent speech and language technology research, software and chip product development, voice message services and e-government system integration. 4. User: "User" is the one who registers, logs in to and uses the software, and enables, views or uploads data in Xunfei Healthcare. It is more often referred to as "You" in this Policy.

 

5. Affiliate: "Affiliate" refers to any party that directly or indirectly controls Xunfei Healthcare Technology Co., Ltd., is controlled by Xunfei Healthcare Technology Co., Ltd. or is jointly controlled with Xunfei Healthcare Technology Co., Ltd. The terms "control" and "controlled" herein refer to the right to supervise the management policy of a party through voting, contract or other means, respectively.

 

6. Account: "Account" is the user account you own after you have completed the registration with real information, and you are responsible for keeping the user account. You shall be held legally responsible for all actions carried out under your account.

9. Personal Information Processing: "Personal Information Processing" includes the personal information collection, storage, use, processing, transmission, provision, disclosure, deletion, etc.

 

10. Personal Information Processor: "Personal Information Processor" is an organization or individual who independently decide on the purpose and mode of processing in personal information processing.

 

11. Subject of Personal Information: "Subject of Personal Information" refers to the natural person identified by or associated with personal information.

 

12. Automated Decision-making: "Automated Decision-making" is the activity of making decisions based on automatically analyzing and evaluating personal behavior habits, hobbies, financial situation, health and credit status through computer programs.

 

13. De-identification: "De-identification" is the process in which personal information cannot be identified without the help of additional information through technical processing of personal information.

 

14. Anonymization: "Anonymization" is the process in which a specific natural person cannot be identified, and the processed information cannot be restored through the technical processing of personal information.

 

15. Device: "Device" is your desktop computer, laptop, tablet, or smartphone that can be used to access Xunfei Healthcare services.

 

16. Unique Device Identifier: "Unique Device Identifier" (exclusive ID or UUID) is a string of characters compiled into a device by the device manufacturer that can be used to identify the corresponding device in a unique way (IMEI of mobile device). Unique device identifiers can be used for a variety of purposes, including providing advertisements when cookies are not available.

 

17. IP Address: Each device that accesses the Internet will be assigned a number, known as an "IP Address". These numbers are usually assigned based on geographical areas. IP addresses are often used to identify where a device is when it is connected to the Internet.

 

18. SSL: "SSL" (Secure Socket Layer) is a security protocol implemented on the Transport Communication Protocol (TCP/IP). SSL supports various types of networks and provides three basic security services, all of which achieve the effect of information confidentiality through the use of public key and symmetric key technology.

 

19. Information Collection Technology: The "automatic collection" described by Xunfei Healthcare  in this Policy includes the following ways:

(a) Cookie: "Cookie" is a small text file placed by the web server in the client (your computer, mobile phone or other intelligent terminals) when you browse the web, which can be used to improve your experience.

(b) Log File: "Log File" stores some automatically collected data, including IP address, browser type, Internet service provider (ISP), reference/exit page, operating system, date/time stamp and clickstream data, etc.

(c) ET Tag: "ET Tag" is a HTTP header transmitted between Internet browsers and Internet servers. Instead of Cookie, it can be used to track individual users, so that we can better understand and improve our services.

(d) JavaScript: "JavaScript" is a programming language for making more interactive and dynamic web pages. JavaScript can be used to set Cookie, read Cookie and delete Cookie.

You do not need to provide personal information to visit and browse the official website of Xunfei Healthcare. In addition, in order to provide you with other functional services such as "product solutions" and "contact us", you only need to provide us with the basic necessary personal information corresponding to the function, except where there are special requirements in relevant laws, regulations and normative documents. 1.2 Contact us

The scope of necessary and unnecessary information. If you use "Contact us", we will collect your name, company name, contact information (phone number), email, city, product demand information to learn your feedback and needs, so that we can contact you to better know your needs and offer solutions to related problems, or help you solve other problems. We will create a personal work order for you according to the name and contact information (phone number) provided by you as your account, and you need to enter the SMS verification code so that we can verify the identity information; we will know your area and specific needs according to the city name and product demand information you provide, and arrange service staff in the corresponding region to contact you in order to respond to your needs. Please note that the email and your company are unnecessary information, and your refusal to provide such information will not affect your normal feedback to us. In order to provide you with after-sales service related to your needs to ensure the normal completion of the service, or to know your experience of using this product and other needs to improve our products and services, or to provide you with other services related to your rights and interests, our staff may use your phone number or other contact information to contact you by phone call, text message or other means so that we can better identify your needs and offer solutions to related problems, or help you solve other problems.

 

2. Personal information that we collect when we deliver products and/or services to you

In compliance with laws and regulations, we will collect and use the following information generated during your use of Xunfei Healthcare products and/or services, in order to ensure the security of your account and provide you with better quality services. Safety maintenance and statistical analysis: When you use Xunfei Healthcare products and/or services, we will automatically collect your device information and the details when using Xunfei Healthcare products and/or services, and save them as a web log. Relevant necessary information includes browser information (browser type, plug-in, language, font, perceptual hash value for image, cache under domain name), operating terminal information (operating system, region, operator), IP address, URL of the page viewed, information on the date, time and duration of accessing the service, browsing information (browsing record, download record and click record), so that we can perform a statistical analysis of the use of Xunfei Healthcare products and/or services, troubleshoot problems, ensure service stability and network security, and analyze operations based on statistics, to improve and optimize interactive experience.

(a) According to the personal information you provide to us and the personal information we collect, including your contact information, device information and log information, we may build user persona based on such information to provide you with a page display that better meets your needs. We may call you or send you marketing SMS through the phone number in your account information. Please be aware that according to the relevant laws and regulations, you have the right to refuse information push and marketing to individuals through automated decisions. If you refuse SMS push (including marketing SMS), you can unsubscribe through the unsubscription method provided in the SMS.

 

(b) The sensitive personal information we collect has been markedly displayed in this Policy. 1. The use of Cookie

Ⅳ. HOW WE PROCESS, SHARE, TRANSFER AND PUBLICLY DISCLOSE YOUR PERSONAL INFORMATION

iii) Sharing with affiliates. Your information may be shared among our affiliates, in order to be associated with our other products or services, to provide you with better services, or to protect the personal and property safety of our affiliates or other users or the public. For example, we need to check the global uniqueness of Xunfei Healthcare account to be registered/bound, in order to avoid repeated registration/binding. For information shared with affiliates, we will require affiliates to take no less stringent privacy protection measures for your information than those stated in this Policy, and strictly comply with relevant laws, regulations and regulatory requirements. Affiliates will need to seek your authorization again if they want to change the purpose of processing personal information.

iv) Sharing with suppliers, service providers and other partners. We may send the information to suppliers, service providers and other partners who support our business. This support includes providing technical infrastructure services, analyzing how our services are used, measuring the effectiveness of advertisements and services, and providing customer services or conducting academic research.

3. Transfer

We will not transfer your personal information to any third party (including companies, organizations and individuals), except in the following cases:

iii) In the event of merger, acquisition or bankruptcy liquidation of this product and/or service provider, or other situations involving merger, acquisition or bankruptcy liquidation, we will inform you of the name and contact information of the recipient, and require the new recipient who holds your personal information to continue to be bound by this Policy if personal information transfer is involved, and we will ask the recipient to re-seek authorization from you if the recipient changes the original purpose and method of processing.

 

4. Public disclosure

5. Exceptions to prior authorization and consent for the processing, sharing, transfer and public disclosure of personal information

We may process, share, transfer or publicly disclose your personal information without your prior authorization or consent, if:

i) it is related to our performance of obligations under laws and regulations;

ii) it is directly related to national security or national defense security;

iii) it is directly related to public safety, public health or vital public interests;

iv) it is directly related to criminal investigation, prosecution, trial and judgment enforcement, etc.;

v) it is difficult to obtain your consent but the purpose is to protect vital legitimate interests about life and property for you and others;

vi) personal information is disclosed by you to the public;

vii) personal information is collected from those disclosed legally and publicly, such as legal news reports and government publications.

 

Please be aware that if we share or transfer, under applicable laws, de-identified personal information and ensure that the recipient of the data cannot recover and re-identify the subject of personal information, which is not an act of sharing, transfer and public disclosure of personal information to others, the storing and processing of such data will not be subject to your prior notice and consent.

 

Ⅴ. HOW WE PROTECT YOUR PERSONAL INFORMATION

1. We attach great importance to users' privacy and personal information protection, and will take reasonable measures to protect users' personal information. Except as otherwise stipulated by laws and regulations or otherwise stipulated in this Policy, we will use various security technologies and procedures to establish a sound management system to protect your personal information from unauthorized access, use or disclosure. 2. You understand and agree that we have the right to conduct technical analysis of the entire user database without disclosing individual user privacy data, and only the user data that is anonymized after analysis and cleansing can be used commercially.

 

3. Data security measures:

(a) We will adopt security measures that meet industry standards, including the establishment of reasonable institutional specifications and security techniques to prevent unauthorized personal information access and modification to avoid data damage or loss. For example, our network service adopts encryption technologies such as TLS and browsing services are provided through https and other ways to ensure the security of user data in the process of transmission; we adopt encryption technology (TLS, SSL), anonymization or de-identification and protection mechanism to encrypt and store users' personal information, and isolate it through isolation technology; we manage and regulate the storage and use of personal information by establishing data classification and grading system, data security management specification and data security development specification; we only allow employees and partners of us and our affiliates who need to know this information to access personal information through confidentiality agreements and other means, and we have set up strict access control and monitoring mechanisms while requiring all people who have access to your personal information to comply with the corresponding confidentiality obligations. Ⅵ. HOW WE STORE YOUR PERSONAL INFORMATION

The products and/or services are only available in the Chinese mainland (for the purposes of this Policy only, excluding Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan). In principle, the personal information we collect within the territory of the People's Republic of China is stored within the territory of the People's Republic of China and will not be transmitted across borders.

 

1. Location where information is stored

We abide by the provisions of laws and regulations, and the information and materials collected about you will be kept on the server of Xunfei Healthcare Technology Co., Ltd. within the territory of the People's Republic of China, except in the following cases:

i) it is clearly stipulated in laws and regulations;

ii) your express authorization is given;

iii) there are personal behaviors such as cross-border transactions via the Internet.

 

2. Time limit for storage

In general, we will retain your personal information only for the minimum period of time necessary for achieving the purposes of processing set forth in this Policy during your use of Xunfei Healthcare products and/or services, unless otherwise provided for by applicable laws and regulations or national regulatory documents. Specific laws and regulations for your reference include:

(a) Article 21, Chapter Ⅲ of Cybersecurity Law of the People's Republic of China stipulates that network operators shall adopt technological measures for recording and tracking the status of network operations, and for monitoring and recording cybersecurity incidents, and preserve network logs according to regulations for no less than six months.

(b) Article 31, Chapter Ⅱ of E-Commerce Law of the People's Republic of China stipulates that information about commodities and services and deals concluded shall be kept for no less than three years from the date on which deals are completed; where this matter is otherwise stipulated in other laws and administrative regulations, the applicable provisions in such laws and administrative regulations shall prevail.

 

After going beyond the above time limit, or after you voluntarily ask to delete your personal information or cancel your account, we will delete your personal information as soon as possible in accordance with the requirements of applicable laws and regulations, unless it is required by applicable laws and regulations or national regulatory documents to retain such information for a longer period of time. However, we will change the storage time of personal information in accordance with the legal requirements in the following cases: 

i) to abide by the provisions of the applicable laws and regulations;

ii) to comply with the provisions of court judgments, rulings or other legal proceedings;

iii) to comply with the requirements of relevant government agencies or legally authorized organizations;

iv) we have reason to believe that it is necessary to abide by the provisions of the relevant laws and regulations; 

v) for purposes that are reasonably necessary for implementing the relevant service agreements or this Policy, for safeguarding the social and public interests, and for protecting the personal and property safety or other legitimate rights and interests of our clients, us, other users or our employees.

 

After you terminate the use of Xunfei Healthcare, we will stop the collection and use of your information, unless otherwise stipulated by laws and regulations or regulatory authorities. When the relevant services of Xunfei Healthcare cease operation, we will notify you of it in the form of push notice and announcement, and delete your personal information left in the server within the time limit required by laws and regulations.

 

Ⅶ. HOW YOU REALIZE THE RIGHT TO MANAGE YOUR PERSONAL INFORMATION

1. In accordance with the relevant laws, regulations and standards of China, you enjoy a number of rights in personal information processing, including:

i) the right to know and make decisions about your personal information processing, and the right to restrict or refuse others to process your personal information, except as otherwise provided for by laws and administrative regulations;

ii) the right to check and copy your personal information from the personal information processor, except as otherwise provided for by laws;

iii) the right to request that your personal information be transferred to your designated personal information processor;

iv) the right to request the personal information processor to correct or supplement your personal information if it is found to be inaccurate or incomplete;

v) the right to request deletion of your personal information;

vi) the right to request personal information processor to explain their personal information processing rules.

vii) the right for your close relatives to check, copy, correct and delete your relevant personal information in accordance with the relevant laws and regulations, but you can contact us to make other arrangements.

v) we have sufficient evidence to show that you have ill will or abuse rights;

vi) it is difficult to obtain your consent but the purpose is to protect vital legitimate interests about life and property for you and others;

vii) responding to your request will cause serious damage to the legitimate rights and interests of you or other individuals or organizations;

viii) trade secrets are involved.
